A mooring in Spain offers boat owners an attractive opportunity to enjoy the Mediterranean in a relaxed manner. Buying and selling a mooring in Spain with the involvement of the property company – usually a Club Náutico – contains a number of pitfalls that should be taken into account by the parties involved.
The following aspects should be considered when buying and selling:
- Regulation of moorings: The terms and conditions for the use of moorings are generally regulated by the state; they are managed by Club Náuticos (Yacht Clubs).
- Rights of use instead of ownership: No acquisition for ownership possible. Moorings belong to the Spanish coast and therefore to the state. Private individuals can only acquire and sell a right of use.
- Pre-authorisation by the Club Náutico: As the moorings are operated by Club Náuticos, the sale generally requires pre-authorisation from the relevant club. This requires notification of the exact conditions of sale in advance.
- Taxes: The sale of moorings is taxable as a commercial transaction. The seller must pay tax on the purchase price received.
